Please read these Terms and Conditions ("Terms") carefully before using the website at www.glossytub.com or engaging the services of GlossyTub Refinishing ("Company," "we," "us," or "our"). By accessing our website or requesting our services, you ("Client" or "you") agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Scope of Services

GlossyTub Refinishing is a family-owned surface refinishing company operating in central New Jersey. Our services include, but are not limited to:

• Bathtub and shower pan refinishing (porcelain, fiberglass, acrylic, cast iron, clawfoot)

• Tile refinishing and regrouting

• Countertop refinishing

• Tub chip repair

• Bathtub color change and custom color services

• Non-slip floor treatment

• Fiberglass repair

The specific scope of work for each project will be confirmed in writing via a quote or proposal provided to the Client before work commences. Services not listed in the approved quote are not included unless separately agreed in writing.

2. Estimates and Quotes

We offer free estimates to all prospective clients. Quotes provided by us are based on the information and/or photos submitted at the time of the request. Final pricing is subject to on-site inspection and may be adjusted if actual conditions differ materially from what was described or depicted. Any changes to scope or pricing will be communicated to the Client and require written or verbal approval before additional work proceeds.

Quotes are valid for 30 days from the date of issuance unless otherwise stated.

3. Scheduling and Appointments

Appointments are scheduled based on our availability. We will confirm your appointment in advance by phone or email. We ask that you:

• Ensure the work area is accessible and cleared of personal belongings prior to our arrival.

• Provide adequate ventilation as required for refinishing work.

• Ensure an adult (18+) is present at the property during the service.

If you need to reschedule or cancel, please notify us at least 24 hours in advance. Failure to provide timely notice may result in a cancellation or rescheduling fee as communicated at the time of booking.

4. Client Responsibilities

To ensure satisfactory results, the Client agrees to:

• Disclose any known pre-existing conditions, damage, or non-standard surfaces prior to the service appointment.

• Remove or properly store any items in or around the work area that may be damaged by overspray, fumes, or incidental contact.

• Follow all post-service care instructions provided by our technicians, including cure time restrictions (typically 24–48 hours before using the refinished surface).

Failure to follow post-service care instructions may void applicable warranties. We are not responsible for damage resulting from premature use or improper maintenance after service completion.

5. Warranty

5.1 Residential Warranty

GlossyTub Refinishing provides a 3-year warranty on residential refinishing work. This warranty covers peeling, flaking, or adhesion failure of the refinishing coat under normal use conditions.

 

5.2 Commercial Warranty

Commercial projects (hotels, motels, military bases, university housing, and other high-traffic environments) are covered by a 1-year warranty.

 

5.3 Warranty Exclusions

The warranty does not cover:

• Damage resulting from misuse, abuse, impact, scratches, harsh abrasive cleaners, or bleach-based products

• Damage caused by failure to follow post-service care instructions

• Pre-existing structural defects, cracks, or rust not addressed in the original scope of work

• Normal wear and tear

• Work performed or altered by third parties after our service

 

5.4 Warranty Claims

To submit a warranty claim, contact us at Crowntubs@gmail.com or (732) 595-2608 with a description and photographs of the issue. We will respond within a reasonable time and, if the claim is valid under this warranty, schedule a corrective service at no additional charge.

6. Payment Terms

Payment is due upon completion of services unless otherwise agreed in writing. We accept payment by [cash / check / electronic transfer — confirm with Company]. Late payments may be subject to a late fee as communicated in your invoice. In the event of non-payment, we reserve the right to pursue collection through lawful means.

For larger projects requiring deposits, the deposit amount and terms will be specified in the written quote.

7. Limitation of Liability

To the fullest extent permitted by applicable law, GlossyTub Refinishing's total liability to you for any claim arising from or related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.

We are not liable for:

• Indirect, incidental, special, consequential, or punitive damages

• Loss of use, loss of profits, or property damage not directly caused by our negligence

• Delays or failure to perform resulting from causes beyond our reasonable control (including weather, supply chain disruption, or acts of God)

Nothing in these Terms limits liability for death, personal injury caused by our negligence, or any other liability that cannot be excluded by law.

8. Intellectual Property

All content on www.glossytub.com, including text, images, logos, service descriptions, and project photos, is the property of GlossyTub Refinishing or its licensors and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

Project photos submitted by clients for quote purposes remain the property of the client. By submitting photos, you grant us a non-exclusive, royalty-free license to use such photos internally for service delivery purposes.

9. Website Use

By accessing our website, you agree not to:

• Use the website for any unlawful purpose or in violation of these Terms

• Attempt to gain unauthorized access to any part of the website or its underlying systems

• Submit false or misleading information through any contact or quote form

• Upload or transmit any viruses, malicious code, or harmful content

• Scrape, harvest, or collect data from our website without our consent

We reserve the right to suspend or terminate access to the website for any user who violates these Terms.

10. Third-Party Platforms

Our website is hosted on Wix.com. Our services are promoted on third-party platforms including Google, Facebook, Instagram, and X (Twitter). Use of those platforms is subject to their own terms of service and privacy policies. GlossyTub Refinishing is not responsible for the availability, accuracy, or practices of any third-party platform.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions. Any dispute arising from or related to these Terms or our services shall first be subject to good-faith negotiation between the parties. If negotiation is unsuccessful, the parties agree to submit the dispute to non-binding mediation in New Jersey before pursuing litigation.

Any legal action shall be brought exclusively in the state or federal courts located in New Jersey. You consent to personal jurisdiction in those courts.

12. Indemnification

You agree to indemnify, defend, and hold harmless GlossyTub Refinishing, its owners, employees, agents, and contractors from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of our website or services; (b) your violation of these Terms; or (c) your failure to follow our post-service care instructions.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on our website with an updated effective date. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.

14. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with any written service quote or agreement, constitute the entire agreement between you and us regarding the subject matter herein.
